MK Confidential opens on the line outside the Orange County Courthouse, which for six weeks has been forming at three in the morning, people waiting for a seat in a room they have only watched on television. Twenty-five floors up, on July 5th, 2011, Judge Belvin Perry, Jr. opens the verdict form, reads it, then reads it again, to be sure. Jose Baez holds Casey Anthony’s hand. Not guilty of first-degree murder. Not guilty of aggravated child abuse. Not guilty of aggravated manslaughter.
Megyn takes up the question people have argued about ever since: why did this jury acquit? Juror number three, a nursing student named Jennifer Ford, says Casey’s bad behavior is not enough to prove a crime. Twelve people will give twelve different answers for how Caylee Marie Anthony died. Judge Perry was prepared to tell the jurors before deliberations that “how” is not an element of the crime. The prosecution never asked. Thirteen months later, two men in Phoenix recover an Internet search record the sheriff’s office had missed. On the last afternoon Caylee was seen alive, someone on the Anthony family computer searched a misspelled phrase: “foolproof suffocation.” Nothing establishes whose hands were on the keyboard, and the jury never heard it. On Suburban Drive, a man named Wally Goodnough keeps bringing wooden crosses to the spot Caylee Marie’s body was found. Someone keeps taking them. Wally keeps coming back.
