Gabriel Hostin’s legal troubles now appear to be behind him.
The son of The View co-host Sunny Hostin reportedly completed a pre-arraignment diversion program that has revolved the case against him stemming from a June 16 citation after police accused him of trespassing on train tracks in Westchester County, New York.
The Incident
Gabriel was stopped by Metropolitan Transportation Authority (MTA) police along the Metro-North railroad tracks near the New Rochelle train station after officers alleged he was in an area marked with “No Trespassing” signs.
Body cam footage showed police placing Gabriel, who graduated from Harvard University in 2025, in handcuffs and escorting him to a nearby sidewalk before the cuffs were removed. He told them he was out for a run and saw an open gate. Soon after, his mother arrived on the scene and started rattling off the credentials that were apparently supposed to sway the police into looking the other way.
“I’m a former federal prosecutor. He knows. He’s a Harvard grad who teaches fourth grade geometry to South Bronx kids,” Sunny argued. “He’s not a kid who’s ever in trouble. It’s an innocent mistake.”
The View host also mentioned the fact that she had a “big interview” that day (Vice President J.D. Vance had been a guest on the show) and that her son apparently does research at Yale University, another boost to his Ivy League bonafides.
After cops ran a criminal background check, the 24 year old received a trespass violation for what could have been an arrestable offense. But even that didn’t satisfy the Hostins.
“Is this necessary,” Gabriel asked the officers who, in unison, responded, “Yes.”
“What happens if you didn’t do it,” he asked in reference to the summons ticket. The officers said their “hands were tied” because of all the nearby cameras, but they explained that they were lessening the offense due to his cooperation and lack of priors.
Case Closed
Gabriel had been scheduled to appear in New Rochelle City Court on July 31, but that court date was postponed until September, signaling some kind of deal had most likely been reached.
In a letter to Westchester Assistant District Attorney Amanda Greene, who was the prosecutor on the case, obtained by TMZ, Sunny argued her son mistakenly entered the property while out for a jog after spotting what appeared to be a gravel incline suitable for hill training. She claimed the entrance gate was open and the only “No Trespassing” sign was not visible when he entered. She also requested the case be dropped.
“My client is a 2025 Harvard University graduate with no criminal history or prior contact with the criminal justice system,” Sunny wrote. “He is an avid runner and former Junior Olympian track athlete who was in the area training.”
According to TMZ, prosecutors repeatedly offered Gabriel the opportunity to participate in the Fresh Start program, a three-hour educational course. After initially insisting the case be dismissal, he accepted the offer and completed the course on August 20.
Megyn’s Take
On Monday’s edition of The Megyn Kelly Show, Megyn noted the resolution of the case was not unusual – but the Hostins’ behavior certainly was. “It was a trespassing case. It got downgraded and dismissed because he completed this [diversion] program, which would have been offered, I think, to most people,” she noted.
“He completed it, but not without his mother to the end injecting herself in this, writing a letter on his behalf as a former federal prosecutor and reminding everybody that her son is a Harvard graduate. The same thing she said when she rushed to his defense on site,” Megyn explained. “This person is constantly bitching about white privilege and how she doesn’t have it. Her son went to Harvard. He’s got Harvard privilege, and she wanted the courts and everybody else involved in his arrest to know it to the end.”
As Megyn noted, Sunny did not seem to change her tactic even in the wake of scrutiny and allegations of hypocrisy. “Even when she was under public scrutiny for trying to rescue her so-called young son – he’s mid-twenties – she kept doing it. Behind the scenes, really wanted everybody to know he’s from Harvard, i.e. a good person,” she said.
“I don’t want to hear another word from her ever again on privilege… because most people’s son did not go to Harvard. Most people are were not born to a former federal prosecutor, and they don’t have their mommy rushing in at every turn, every minor interaction with the law, which this guy wants us to believe this was,” she continued. “Why couldn’t he handle it himself? Why couldn’t he get a lawyer? Why couldn’t he have just paid the trespassing fine?”
Megyn posited there is but one explanation: Harvard. “A Harvard graduate can’t have any marks on his record, you see, because he’s a future leader. He’s a future king, unlike your son or mine. That’s how Sunny Hostin sees the world.”
