‘A Complete Dereliction’: Megyn Slams Judge’s Light Sentence for Kavanaugh’s ‘Trans’ Attempted Assassin

Supreme Court Justice Brett Kavanaugh’s attempted assassin purportedly got a gender change and a shockingly lenient prison sentence thanks to a Biden-appointed judge.

U.S. District Judge Deborah Boardman gave the man, who pleaded guilty to one count of attempted assassination of a Supreme Court justice back in April, what amounted to a slap on the wrist on Friday, sentencing him to just eight years and one month in prison. Prosecutors had asked for a sentence of 30 years to life.

The Sentence

As part of his guilty plea, Nicholas Roske – now 29 years old and transgender with the female name Sophie – admitted he flew from Los Angeles to Dulles International Airport with a firearm and ammo in his checked suitcase before taking a taxi to Kavanaugh’s neighborhood with the intent to kill him. Court filings show Roske wanted to take out the justice before he could vote to overturn Roe v. Wade.

As reported on Monday’s AM Update, the incident happened after a draft of that decision was leaked to the media – a leak that was never investigated by anyone other than the Supreme Court marshal who didn’t solve it. Roske didn’t follow through with his plot after seeing law enforcement guarding the Kavanaugh residence. He ultimately called 911, saying he had suicidal thoughts and needed psychiatric help.

During the sentencing hearing, Boardman gave Roske credit for calling 911 and was careful to use Roske’s preferred pronouns and new name. “This is an atypical defendant and an atypical case,” she claimed. “Though she got far too close to executing her plans, the fact remains she abandoned them. Sophie Roske’s admission of guilt and effort to come clean did not occur after or even because she was caught in the act by police. If she had not called 911, law enforcement would never have known about Sophie Roske and her plot to kill a Supreme Court justice.”

The judge even admitted Roske’s “gender transition” played a role in her decision. “I take into consideration the conditions of pre-trial confinement and the fact that she is a transgender woman and will be sent to a male-only [Bureau of Prisons] facility,” Boardman added.

Judge Boardman spent a year in Jordan after college as a Fulbright scholar. Later, she served as a federal public defender for 11 years. She was among the first district court judges to block President Donald Trump’s executive order to end birthright citizenship earlier this year.

Attorney General Pam Bondi vowed to appeal the light sentence, calling it a “woefully insufficient sentence” that “does not reflect the horrific facts of this case.” It should be noted, however, that the standard of review on an appeal of a federal sentence is typically deferential to the district court judge.

Megyn’s Take

On Monday’s edition of The Megyn Kelly Show, Megyn reacted to defendant’s gender identity claims and explained why she believes the judge should be impeached over the sentence.

“It seems to me, [this is a guy] who, after trying to assassinate Brett Kavanaugh, decided he would do much better if he claimed he was a woman. [He likely] recognized there was a very high likelihood – since he was in federal custody, and had confessed, and his plan was all over his social media and his emails and so on – that he’d probably do better if he just owned it… as a woman… Keep in mind, this all happened during 2022 under Joe Biden. He had a much better chance of going to a woman’s prison, where he would prefer to spend the rest of his life versus a male’s…

So, this guy decided to suddenly declare himself trans. And what this judge says… is that in 2020, which had been two years before the assassination attempt, he secretly… declared himself to be a trans woman… but, oh so conveniently, no one else knew about that until after he tried to assassinate a Supreme Court justice… That’s when he came out with it. Wonder what his inspo was to go full trans. 

This woman, Deborah Boardman, doesn’t give a sh-t. She loved having the excuse to let him out in as little as four years with good behavior, potentially… [saying she took into consideration] that [Roske] “is a transgender woman and will be sent to a male-only [Bureau of Prisons] facility”…

Way to get every single man coming in front of you, judge, to declare that he’s a woman. Way to flood the female prisons with men pretending to be women who have zero gender dysphoria or confusion… You just endangered whole scores of female prisoners who are serving their sentences the way they should be after committing terrible crimes that landed them in the joint who now are going to have to share cells with men who are sex offenders, men who are serial rapists. Those are the ones most likely to feign gender confusion…

You, madam, are part of the problem. Not to mention what you’ve just done to Brett Kavanaugh, his wife, his mother, and his family that now have to worry he has four years until he can no longer live in peace all because you believe in gender ideology and you believe this nonsense that was spoon fed to you by Roske, who, The Daily Wire’s Luke Rosiak reported, appeared [in court] “as a tall man with a deep voice.” He made no attempt to even hide the fact that he is a man. He’s not even trying to look female. He knows he doesn’t have to. He just has to say the magic words…

This woman, this Biden appointee, should be impeached. Forget reversed. She should be impeached. What she did is a complete dereliction.”
