Donald Trump wasted absolutely no time getting to work on the agenda he ran on after being sworn into office two weeks ago. He promptly signed hundreds of executive orders addressing everything from border security and citizenship to DEI and gender.
The Executive Orders
On the DEI front, Trump’s executive action titled “Ending Radical and Wasteful Government DEI Programs and Preferences” ends diversity, equity, and inclusion policies and programs at the federal level.
The president also tackled another key social issue of the 2024 election cycle with his orders related to radical gender ideology. In addition to ending the use of the term ‘gender’ in federal documents and recognizing male and female as the only two sexes, Trump signed the “Protecting Children from Chemical and Surgical Mutilation” order to end federal support for ‘trans’ surgeries and the use of puberty blockers and cross-sex hormones in minors.
And then there is the issue of birthright citizenship. Trump signed the “Protecting the Meaning and Value of American Citizenship” order on Inauguration Day, which challenges the scope of the Fourteenth Amendment and its “subject to the jurisdiction thereof” verbiage.
The administration is arguing citizenship should not automatically extend to those born in the United States (1) if the person’s mother was unlawfully in the U.S. and the father was not citizen or lawful permanent resident at the time of the birth, or (2) when the mother’s presence at the time of said person’s birth was lawful but temporary.
The Legality
While president’s have the authority to invoke dramatic policy changes via executive order, they are not immune from legal challenge. Lawsuits have already been filed against several of Trump’s actions, and the implementation of policies that involve federal vs. state jurisdiction and public vs. private institutions will also prove challenging.
